1. Purpose
This policy demonstrates the commitment of MPMA and MPRT to comply with all applicable local, state, national, international, recruitment, training, labour, safety, welfare, documentation, and overseas deployment-related laws and regulations.
MPMA is a registered overseas recruitment agency in India and carries out its duties legally under the applicable regulatory framework, including the Ministry of External Affairs and Protector of Emigrants requirements.
MPRT is the training centre of MPMA and is established with due diligence, proper infrastructure, high standards, safety protocols, and compliance procedures suitable for preparing candidates for overseas employment.
MPMA and MPRT recognise that overseas employment must be carried out through lawful, ethical, transparent, and responsible migration practices.
2. Scope
This policy applies to:
1. MPMA’s recruitment and deployment-related activities.
2. MPRT’s training, trade testing, and candidate preparation activities.
3. Employees, trainers, consultants, vendors, representatives, candidates, and stakeholders connected with MPMA and MPRT.
4. Candidate records, training records, recruitment records, statutory records, and compliance documents.
3. Compliance Commitment
MPMA and MPRT shall comply with:
1. Applicable laws of India.
2. Ministry of External Affairs requirements.
3. Protector of Emigrants procedures and guidelines.
4. Emigration-related rules and documentation requirements.
5. Ministry of Manpower requirements wherever applicable.
6. Embassy, consulate, and destination-country requirements.
7. Labour, immigration, manpower, safety, and jurisdictional laws of destination countries.
8. Applicable local body, labour, tax, safety, and establishment-related laws.
9. International labour standards and ethical recruitment principles, wherever applicable.
4. Key Compliance Areas
MPMA and MPRT shall maintain compliance in the following areas:
1. Company registration and business records.
2. Overseas recruitment registration and related approvals.
3. Candidate enrolment, verification, and documentation.
4. Training centre standards.
5. Trade testing and skill assessment support.
6. Candidate attendance, training, and certification records.
7. Employment offer, demand letter, contract, visa, and deployment-related documentation.
8. Fee collection, receipts, invoices, and transparent financial records.
9. Labour law compliance for employees and staff.
10. Workplace safety, fire safety, first aid, hygiene, and emergency preparedness.
11. Tax and statutory filings, wherever applicable.
12. Data protection and confidentiality of candidate and client information.
13. Anti-bribery, anti-corruption, and anti-fraud compliance.
14. Candidate grievance and welfare mechanisms.
15. Compliance with destination-country manpower and immigration laws.
5. Training Centre Due Diligence
MPRT has been developed and maintained with due diligence and with the objective of providing candidates with structured training, discipline, safety awareness, and practical exposure relevant to overseas employment.
MPRT shall ensure:
1. Safe and suitable training infrastructure.
2. Proper supervision during practical training.
3. Qualified and competent trainers wherever required.
4. Training attendance and assessment records.
5. Safety instructions for candidates.
6. Basic welfare facilities.
7. Clean and organised training areas.
8. Proper use and maintenance of tools, equipment, vehicles, and training materials.
9. Emergency contacts and first-aid arrangements.
10. Incident reporting and corrective action procedures.
6. Internal Compliance Procedure
MPMA and MPRT shall follow the below compliance procedure:
1. Maintain a list of applicable registrations, licences, records, renewals, and statutory obligations.
2. Assign responsible persons for compliance, documentation, candidate records, training records, and safety records.
3. Maintain a compliance and renewal calendar.
4. Keep proper records of candidates, employees, trainers, vendors, payments, receipts, training, testing, and deployment.
5. Conduct periodic internal reviews of records and procedures.
6. Correct any non-compliance or gap identified during review.
7. Maintain copies of records and make them available for inspection or verification when required.
8. Report serious compliance issues to management immediately.
7. Candidate Records and Documentation
MPMA and MPRT shall maintain proper records relating to:
1. Candidate application and enrolment.
2. Identification documents.
3. Educational and experience records, wherever applicable.
4. Training attendance.
5. Trade test or assessment records.
6. Fee receipts.
7. Selection and client-related documents.
8. Employment contract and offer documents, wherever applicable.
9. Visa and emigration-related records, wherever applicable.
10. Deployment and travel-related documentation, wherever applicable.
8. Compliance with Destination-Country Laws
MPMA and MPRT recognisethat every destination country has its own labour, manpower, immigration, safety, and jurisdictional requirements.
MPMA and MPRT shall respect and comply with the applicable requirements of the respective destination country, including Ministry of Manpower regulations, foreign employer requirements, embassy procedures, work permit rules, and labour standards wherever applicable.
10. Anti-Fraud and Document Integrity
MPMA and MPRT shall not support, permit, or tolerate forged documents, false experience certificates, manipulated training records, fake receipts, false employment claims, or unauthorised alterations to official records.
Any suspected document manipulation or fraud shall be reviewed seriously and appropriate action shall be taken.
11. Grievance Mechanism
Candidates, trainees, employees, or stakeholders may raise concerns relating to safety, misconduct, harassment, discrimination, illegal fee collection, document handling, training issues, or unethical practices.
Complaints shall be reviewed fairly, confidentially, and without retaliation.
12. Monitoring and Review
This policy shall be reviewed periodically and updated whenever required due to changes in law, regulation, training activity, recruitment process, estination-country requirement, or authority direction.
13. Declaration
MPMA and MPRT hereby declare that they are committed to conducting all activities legally, ethically, transparently, and in accordance with applicable laws and regulations.
MPMA and MPRT further declare that the training centre has been established with due diligence,
appropriate standards, safety protocols, and compliance systems to support the lawful training and overseas deployment of candidates.
14. Approval
This Applicable Legal and Statutory Compliance Policy & Procedure is approved by the management of MPMA and MPRT.
